关于预防与处理原创演讲比赛中学术不端行为的规则

目的
为了保护我们参赛学生的学术诚信,维护赛事的公平、公正,保护原创作品知识产权,WSDA学术委员会(以下简称委员会)根据《中华人民共和国著作权法》等相关规定,制定本办法。
定义
学术不端行为是指参赛选手个人和/或其教练,在参与WSDA举办的原创演讲比赛中,违反公认的学术准则和/或违背学术诚信的行为。
文稿收集及审查
参加WSDA原创演讲的所有选手,都有义务配合委员会,提交稿件接受审查。选手所提交稿件必须为与当场比赛内容相同的文稿。在被要求提交稿件进行学术审查后,参赛选手不得以任何理由拒绝提交稿件,否则视情节严重程度,有被判罚从取消成绩至终身禁赛的可能。如果选手被证实故意提交与参赛内容不符的稿件,也同样有接受判罚的可能。
委员会保留无需任何理由收集并抽查参赛稿件的权利。当委员会审查人员与被调查者有直接利害关系时,委员会将指派其他成员继续审查以作出回避。在委员会认为必要的情况下,可委托无利害关系的专家或第三方专业机构就文稿进行独立审查。
调查及判定违规
审查结束后,委员会将对存疑的稿件进一步深入调查。当稿件满足包括但不限于下列任意条件之一时,即可判定构成学术不端:
1.抄袭、剽窃、侵占他人作品的
2.直接引用他人作品时超过150词的
3.使用AI生成内容超过150词的
4.直接或间接引用他人作品,无论字数多少,未加注释和说明的
5.篡改或伪造数据,捏造事实且造成不良影响的
6.买卖参赛稿件,或稿件由其他组织或个人代写的
7.翻译源语言或中间语言,至参赛目标语言,以规避检查的
8.意译他人演讲,未经他人授权或不适当引用的
9.其他委员会认定违反赛事规则的学术不端行为

上述示例仅直接地展示了学术不端的几种可能的结果,具体判定违规,委员会将视不同情况进行专业分析和研判。
违规处罚、申诉与复核
一经认定学术不端,委员会将视情节及性质,对相应参赛选手和/或教练等责任人作出如下处理:
1.赛前认定的,告知选手更换稿件并要求重新提交接受审查。
2.赛中认定的,停止该选手的该场后续比赛。
3.赛后认定的,取消该选手本场参赛成绩。已经取得奖项的,将被取消成绩并收回已发出奖项。赛事排名将作出更正并通报全部参赛选手。
4.情节十分严重且证据确凿拒不改正者,终身禁赛,并通报参赛选手所在学校,记入WSDA诚信档案。
5.根据《中华人民共和国著作权法》第47条之规定,有侵权行为的,应当根据情况,承担停止侵害、消除影响、赔礼道歉、赔偿损失等民事责任。
对于认定有学术不端行为的参赛选手,可以在收到处理决定7个自然日内,以书面形式向委员会提出异议或复核申请,并以书面形式列举证据和复核理由。委员会收到申请后,将在15个工作日内复核并作出书面答复。复核结果有三种可能:
1.申诉成功;
2.须补充申诉材料;
3.申诉失败。
当事参赛选手如果对复核结果不服,仍以同一事实理由提出异议或者申请复核的,委员会将不予重复受理。

Regulation Academic Misconduct Prevention and Handling in Original Oratory
WSDA Academic Committee
Purpose
In order to protect the academic integrity of our competition and students, maintain fairness and justice in the competition, and protect the intellectual property rights of original works, WSDA Academic Committee (hereinafter referred to as the Committee) formulated this regulation in accordance with the relevant provisions of the Copyright Law of the People's Republic of China and other regulations.
Definition
Academic misconduct refers to contestants and/or their coaches who violate accepted academic standards and/or violate academic integrity in participating in the original oratory contest organized by WSDA.
Scripts Collection and Reviewing
All contestants participating in WSDA's original oratory contest are obliged to cooperate with the Committee to submit their script for review purposes at any time. The scripts submitted by the contestants must be the same as the content used in the competition. If the Committee considers it necessary, it may entrust a disinterested expert or a third-party professional organization to conduct an independent review of the script.
Investigation and Determination of Violation
After the reviewing process, the Committee will further investigate the suspected script. When a script meets any of, including but not limited to, the following conditions, it can be determined as academic misconduct:
1.Plagiarize, steal or embezzle others' works.
2.Directly cite others' works over the 150 word limit.
3.Directly generate content through AI tools over the 150 word limit.
4.Directly or indirectly cite others' works, regardless of the word count, without annotations and explanations.
5.Falsify or forge data, fabricate facts and cause adverse effects.
6.Purchase/sell scripts, or designate other organizations or individuals to compose the scripts.
7.Translate the source language or intermediate language to the target language used in the tournament in order to hide plagiarism.
8.Paraphrase others' speeches, or work without giving credit or proper citation.
9.Other academic misconduct determined by the Committee to violate the rules of the competition.

The examples above only directly show several possible results of academic misconduct. The Committee will conduct professional analysis and judgment based on different situations when the specific violation is determined.
Violation Penalty, Appealing and Verification
Once the academic misconduct is determined, the Committee will, depending on the circumstances and nature, deal with the corresponding contestants and/or coaches and other responsible persons as follows:
1.When violation activities are determined prior to the contest, the contestants will be notified to recompose the scripts and resubmit for review.
2.When violation activities are determined during the contest, the contestants will not be allowed to participate the subsequent rounds of this contest.
3.When violation activities are determined after the contest, the score for this contestant will be canceled. (S)he who has won awards will be canceled and the awards issued will be withdrawn. The ranking will be corrected and all contestants will be notified.
4.If violation circumstances are extreme serious with very solid evidence, and the violator who refuses to correct, will be banned for life. Violator's school will be notified and this record will be filed in the WSDA Integrity Archive.
5.According to Article 47 of the Copyright Law of the People's Republic of China, any infringement shall bear civil liabilities such as stopping the infringement, eliminating the impact, making an apology, and compensating for losses according to the circumstances.
Contestants who are determined to have academic misconduct can submit an objection, or Review Application to the Committee in written format within 7 calendar days of receiving the decision, and shall list the evidence and reasons for review. After the Committee receives the application, it will be reviewed and replied in written format within 15 working days. There are three possibilities for review results:
1. Appeal succeed;
2. Supplement material needed;
3. The appeal fails.
If the contestant is dissatisfied with the result of the review and still raises an objection or applies for a review on the same grounds of fact, the Committee will not accept and hear the case again.
Others
WSDA has been and will continue be committed to providing a fair and notarized event platform for the majority of contestants. We will stay true to the original aspiration and move forward in future events. WSDA is willing to believe in the honesty and credibility of every contestant, and is more willing to adhere to the basic principles of scientific research and academics. We hope to work together with young people in the future to maintain academic standards and academic ethics.
